Welcome to Cocktale - cocktail recipe (the "App"), operated by Vibgyortech ("we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of the Cocktale mobile application. By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Age Restriction and Responsible Use

By using the App, you represent and warrant that:

• You are of legal drinking age in your country of residence
• You will consume alcohol responsibly and in accordance with local laws
• You understand the risks associated with alcohol consumption
• You will not use the App to promote underage drinking or irresponsible behavior

Vibgyortech strongly encourages responsible drinking. Never drink and drive, and always be aware of your personal limits.

2. Account Registration and Security

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for activities that occur under your account
• Immediately notify us of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

3. License and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.

You May:

• Browse and search cocktail recipes
• Save and organize your favorite recipes
• Share recipes through the App's sharing features
• Use the App for personal, non-commercial purposes

You May NOT:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Transmit any viruses, malware, or harmful code
• Scrape, mine, or harvest data from the App using automated means
• Impersonate others or provide false information
• Use the App to promote commercial products or services without permission

4. Intellectual Property Rights

The "Cocktale" name, logo, and all related marks are trademarks of Vibgyortech. You may not use these marks without our prior written permission.

5. User-Generated Content

If you submit, upload, or share content through the App (such as reviews, comments, or photos), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such content in connection with operating and promoting the App.

You represent and warrant that:

• You own or have the necessary rights to the content you submit
• Your content does not infringe on any third-party rights
• Your content does not contain illegal, harmful, or offensive material
• Your content complies with all applicable laws and regulations

We reserve the right to remove any content that violates these Terms or that we deem inappropriate.

6. Third-Party Content and Links

The App may contain links to third-party websites or services that are not owned or controlled by Vibgyortech. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content or services.

7. Disclaimers and Limitations of Liability

Recipe Accuracy

While we strive to provide accurate and high-quality cocktail recipes, we make no warranties or representations about the accuracy, reliability, completeness, or timeliness of the content. Cocktail recipes are provided for informational and entertainment purposes only.

Service Availability

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE RESERVE THE RIGHT TO MODIFY, SUSPEND, OR DISCONTINUE THE APP AT ANY TIME WITHOUT NOTICE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBGYORTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

8. Indemnification

You agree to indemnify, defend, and hold harmless Vibgyortech, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another.

9. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Vibgyortech operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration authority, except where prohibited by law.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the App.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vibgyortech regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.
